Fired Up Collective – Legal & General Policy
This Legal Policy governs all purchases, installations, and services provided by Fired Up Collective. By engaging with our services, purchasing products, or accepting quotations, the client agrees to the terms outlined below.
1. General Disclaimer
All fireplaces, braais, and heating appliances supplied by Fired Up Collective are live-fire heating systems and must be used responsibly.
⚠️ Fireplaces present inherent risks, including:
- Fire hazards
- Smoke damage
- Carbon monoxide exposure
The client accepts full responsibility for:
- Safe operation
- Proper use
- Ongoing maintenance
2. Installation Liability
- All installations are carried out to industry standards and based on site conditions at the time
- Fired Up Collective will not be held liable for:
- Structural defects or hidden issues within walls, ceilings, or roofs
- Pre-existing conditions affecting installation
- Changes required after installation due to unforeseen circumstances
⚠️ Any modifications required during installation may result in additional costs
3. Third-Party Installation
Where installation is not carried out by Fired Up Collective:
- No liability will be accepted for:
- Incorrect installation
- Poor workmanship
- Damage to the unit or property
⚠️ Manufacturer warranties may be voided if installation is not done correctly
4. Product Use & Safety
The client agrees to:
- Operate the fireplace according to provided guidelines
- Use only suitable fuel (e.g. dry wood where applicable)
- Ensure adequate ventilation at all times
Fired Up Collective will not be liable for:
- Damage caused by misuse or over-firing
- Use of incorrect fuel
- Failure to follow safety guidelines
5. Maintenance & Servicing
- Regular servicing is essential for safe operation
- It is the client’s responsibility to:
- Arrange annual inspections
- Maintain flue systems and chimneys
⚠️ Failure to maintain the unit may:
- Lead to dangerous conditions
- Void warranties
- Release Fired Up Collective from any liability
6. Warranty Disclaimer
- All products are covered by manufacturer warranties where applicable
- Warranty claims are subject to:
- Correct installation
- Proper use
- Regular maintenance
Warranties do not cover:
- Wear and tear
- Consumables (e.g. fire bricks, seals, glass)
- Damage caused by misuse or incorrect installation
7. Limitation of Liability
Fired Up Collective shall not be held liable for:
- Indirect or consequential damages
- Loss of income or business
- Damage to property arising from use or installation
- Any injury resulting from misuse or negligence
⚠️ Liability is limited to the value of the product supplied unless otherwise required by law.
8. Compliance & Regulations
- The client is responsible for ensuring compliance with:
- Local building regulations
- Insurance requirements
- Safety standards
Fired Up Collective will not be held responsible for:
- Non-compliance outside of our direct scope of work
9. Quotes & Variations
- All quotes are based on visible conditions at the time
- Additional work may be required due to:
- Hidden structural issues
- Site changes
⚠️ Any additional work will be quoted and billed separately
10. Indemnity
The client agrees to indemnify and hold harmless Fired Up Collective from:
- Any claims arising from misuse
- Incorrect installation (third-party)
- Failure to maintain or service the unit
- Unsafe operation of the appliance
11. Acceptance of Risk
By purchasing or installing a fireplace, the client acknowledges:
- The risks associated with live-fire appliances
- Their responsibility for safe operation
- That Fired Up Collective has provided adequate guidance
12. Governing Law
This policy is governed by the laws of South Africa.
